Under state law, a teacher has a right to send a student to the office with a discipline referral. Texas Education Code 37.002(a) states: “A teacher may send a student to the principal’s office to maintain effective discipline in the classroom. The principal shall respond by employing appropriate discipline management techniques consistent with the student code of conduct . . . .” According to the SAISD Student code of Conduct, “When a teacher believes a student has committed a violation of this Student Code of Conduct, the teacher is required by Texas law to submit a written description of the student’s actions to the principal or administrator.”
The following guidelines are important with regard to the SAISD Discipline Referral form, and the administration, at the Alliance’s request last school year, reminded
principals of these guidelines:
- Principals shall accept discipline referrals for violations of the SAISD Student Code of Conduct whether or not the “Previous Action Taken by Teacher/Staff” section of the referral is completed since that section is optional on the part of the teacher.
- Principals shall provide appropriate consequences from the SAISD Student Code of Conduct to students who commit an offense from any level of the SAISD Student Code of Conduct.
- Principals shall return the completed discipline referral form to the teacher within five working days.
